These Terms govern your use of Brand Surface (brandsurface.xyz), operated by Marvin Nakaai, an individual based in Brussels, Belgium (“we,” “us”). By using the service you agree to these Terms. If you do not agree, do not use the service.
1. The service
Brand Surface is a guided brand discovery tool. You answer a structured set of questions and receive a strategy document delivered by email and as a private Notion page. The service is provided as-is and we may change or improve it at any time.
2. Eligibility
You must be at least 18 and able to enter a binding contract. By using Brand Surface you confirm you meet these requirements.
3. Your content
Everything you input into the discovery conversation, and the strategy document that results from it, is yours. You own it and can use it for any purpose.
You grant us a limited license to process your content for the sole purpose of delivering the service (generating the strategy, storing it in our database and Notion, sending it to you by email). We may use anonymized and aggregated patterns to improve the product. We will not publish your content, share it with other customers, or use it to train AI models.
4. Acceptable use
You agree not to:
- Submit content that is unlawful, harmful, or infringes the rights of others.
- Attempt to disrupt, reverse-engineer, or probe the service for vulnerabilities (other than via good-faith security disclosure to hello@brandsurface.xyz).
- Use the service to generate content for resale as a competing product.
- Use automated means to scrape or copy the service.
5. Payment and refunds
Pricing is shown on the site at the point of purchase. Payments are processed by Stripe. Refunds are governed by our Refund Policy.
6. Third-party services
Brand Surface uses third-party providers (listed in our Privacy Policy) to deliver the service. We are not responsible for the availability or behavior of those providers, but we choose them carefully.
7. Disclaimers
Brand Surface is a tool to support brand thinking. It is not a substitute for professional legal, financial, trademark, or marketing advice. We do not guarantee that any strategy produced by the service will achieve a particular business outcome.
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, Brand Surface and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data, arising out of or related to your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
9. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using the service at any time. Sections that by their nature should survive termination (ownership, disclaimers, limitations of liability) will survive.
10. Changes to these Terms
We may update these Terms from time to time. The updated date will be shown at the top. Continued use of the service after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Belgium. Any disputes will be subject to the jurisdiction of the courts of Belgium, without prejudice to any mandatory consumer protections you may have in your country of residence under applicable EU law.
